🏛️ FSU and ACC Request Judge’s Order for ESPN Agreement Access 🏛️

Florida State University (FSU) and the Atlantic Coast Conference (ACC) have taken a significant step in their ongoing legal battle.

The two parties have jointly proposed an Interim Protective Order to Leon County judge John C. Cooper, requesting unredacted access to multi-media agreements between the ACC and ESPN. Here’s a detailed look at the key points of this development:

Key Details:

  • Joint Proposal: FSU and the ACC filed a joint request for Judge Cooper to approve an order granting FSU unredacted access to six key documents detailing agreements between the ACC and ESPN.

  • Interim Protective Order: Drafted on July 2, the order awaits Judge Cooper’s approval and may be subject to alterations.

Documents to be Shared:

  1. 2010 ACC Multi-Media Agreement

  2. 2012 Amendment and Extension Agreement

  3. 2014 Second Amendment to Multi-Media Agreement

  4. 2016 Amended and Restated ACC-ESPN Multi-Media Agreement

  5. ACC-ESPN Network Agreement (2016)

  6. Letter Amendment to Amended and Restated Multi-Media Agreement (August 10, 2021)

Confidentiality and Restrictions:

  • Confidentiality: All documents will be marked “Confidential” and must be shared within seven days of the order.

  • Limited Access: FSU can use the documents solely for litigation purposes, and they can only be discussed in legal settings among FSU counsel, court personnel, and mediators.

  • Public Records Requests: If FSU receives a Public Records Request, they must notify the ACC, providing the ACC the chance to intervene.

Document Handling:

  • Return or Destroy: FSU must return or destroy all copies of the documents within 60 days of receipt.

Implications:

  • Strategic Advantage: Gaining unredacted access to these agreements could provide FSU with crucial information and leverage in their lawsuit against the ACC.

  • Public Record Restrictions: While this limits FSU’s ability to publicly disclose the documents, it ensures sensitive information remains protected during the legal process.

This proposed order, if approved, represents a potential win for FSU in their ongoing legal battle, providing them with valuable insights while maintaining confidentiality.
